Incoterms 2020 Air Freight Insurance for US Exports
For US exporters, Incoterms 2020 air freight insurance decisions must separate who pays transportation, where cargo risk transfers and whose policy responds to a loss. Those responsibilities do not necessarily sit with the same party. A seller can pay freight to a foreign airport while the buyer bears transit risk from an earlier US handoff.
That distinction matters when a high-value component moves through pickup, security screening, consolidation, airline handling and destination delivery. Before booking, align the sales contract, delivery milestone and insurance certificate. An air waybill alone does not establish adequate cargo coverage.
Select the rule around the actual delivery point
Seven Incoterms rules work with air transport: EXW, FCA, CPT, CIP, DAP, DPU and DDP. FAS, FOB, CFR and CIF are restricted to sea and inland waterway transport. CIF is not the air freight equivalent of CIP, even when commercial teams use the labels interchangeably.
An Incoterms 2020 air freight contract should identify a precise named place, not simply an airport code or city. The operational consequences differ by rule:
Rule | Delivery and risk-transfer milestone | Required cargo insurance |
EXW | Goods placed at the buyer’s disposal at the named place, not loaded | Neither party is required to insure |
FCA | Delivery to the buyer’s nominated carrier or other person at the agreed point; loading obligations depend on location | Neither party is required to insure |
CPT | Delivery to the carrier at the agreed point, although the seller pays carriage to the named destination | Neither party is required to insure |
CIP | Delivery to the carrier at the agreed point, although the seller pays carriage and insurance to the named destination | Seller must procure qualifying coverage |
DAP | Goods available on the arriving vehicle at destination, ready for unloading | Neither party is required to insure |
DPU | Goods delivered at destination after unloading | Neither party is required to insure |
DDP | Goods delivered import-cleared at destination, ready for unloading | Neither party is required to insure |
“No insurance requirement” does not mean no exposure. It means the rule does not compel either party to purchase a policy.
Apply CIP’s insurance requirement without overstating protection
For an Incoterms 2020 air freight shipment sold CIP, the seller normally must procure insurance equivalent to Institute Cargo Clauses (A), or similar cover, unless the parties agree otherwise. The minimum insured amount is 110% of the contract price, in the contract currency.
For example, a $250,000 contract price produces a default minimum insured amount of $275,000. That calculation does not establish that every loss is covered or that the amount will fund replacement equipment, expedited rebuilding and operational disruption.
Under the ICC’s Incoterms 2020 rules, CIP insurance must cover at least the period from delivery to the carrier through the named destination. The seller must provide insurance documentation enabling the buyer, or another party with an insurable interest, to claim directly from the insurer.
Three practical consequences follow. First, the seller still needs to address its own exposure before delivery to the carrier. Second, the certificate’s endpoint must match the contractual destination. Third, broad physical-loss coverage is not blanket protection against delay, lost production or every temperature excursion.
War and strikes coverage also needs explicit attention. Under CIP, additional coverage requested by the buyer is subject to availability and the rule’s allocation of expense. Confirm the actual endorsements rather than treating them as automatically included.
Close the gaps under FCA, CPT and destination terms
Under FCA, the buyer generally needs coverage attaching no later than the agreed delivery event. At the seller’s premises, FCA delivery occurs when goods are loaded onto the buyer-arranged collecting vehicle. At another named place, delivery normally occurs on the seller’s arriving vehicle, ready for unloading and at the disposal of the nominated carrier or person.
CPT creates a different procurement trap: the seller purchases transportation, but risk transfers on delivery to the carrier at the agreed point. Where successive carriers are involved and no specific delivery point is agreed, the first-carrier handoff becomes especially important.
An Incoterms 2020 air freight insurance review should therefore test the risk-transfer point separately from the freight-payment endpoint. Airline acceptance, security screening and aircraft departure are not interchangeable delivery milestones.
Under DAP, DPU and DDP, sellers retain risk farther into the journey, despite having no rule-based obligation to insure. DDP also adds import-clearance obligations that insurance cannot solve. Assess those separately using the operational distinctions between DDP and DAP in foreign markets.
Do not substitute airline liability for cargo insurance
For international carriage governed by the Montreal Convention, the cargo liability limit increased to 26 Special Drawing Rights per kilogram on December 28, 2024, subject to the convention’s conditions and any applicable special declaration. The IATA Montreal Convention resources explain the treaty framework.
A 100-kilogram shipment therefore has a weight-based liability limit of 2,600 SDR where that limit applies. A shipment containing expensive semiconductor optics or avionics can have a commercial value far above that figure. SDRs are not US dollars and their exchange value changes.
Recovery also depends on legal liability, applicable defenses and the carriage contract. Do not assume that an airline’s international limit governs every truck movement or warehouse handoff.
For Incoterms 2020 air freight procurement, distinguish three separate items: cargo insurance, a declared value for carriage and a declared customs value. A special declaration may increase a carrier’s liability exposure subject to its conditions and charges, but it is not the same product as cargo insurance. Entering a customs value does not automatically purchase either protection.
Incoterms 2020 air freight controls at pickup and arrival
US exports: bind coverage before the first exposed movement
Before a US factory or warehouse releases cargo, document the agreed carrier handoff and confirm which policy covers loading, domestic pickup and delivery into the export facility. For buyer-controlled FCA collections, obtain the buyer’s insurance confirmation before release rather than assuming its global policy attaches correctly.
Align the insurance description with the booking: general consolidation, next flight out, dedicated charter or temperature-controlled service. Record package count, gross weight, serial numbers and packaging condition before custody changes. Coordinate TSA security requirements through the applicable Indirect Air Carrier process and record any package opening or repacking.
The Incoterms 2020 air freight export file should also identify responsibility for EEI filing through AES, any required authorization and the applicable export-license determination. Incoterms do not displace obligations under the Foreign Trade Regulations or other US export controls.
Keep insurance, compliance and booking instructions aligned when arranging US export air freight execution, especially when a buyer nominates the forwarder.
US imports: mirror the controls across the inbound lane
For US-bound cargo, obtain evidence of the foreign pickup condition, export handling and international uplift. Confirm whether seller-procured CIP coverage ends at the US airport, a forwarder’s facility or the consignee’s address. Those locations create materially different exposures.
The inbound operating plan should identify responsibility for US customs-clearance coordination, airport cargo release, terminal transfer and final-mile delivery. Do not assume an airport-to-airport policy continues through a customs hold or subsequent truck delivery merely because the forwarder coordinates those services.
Apply the same Incoterms 2020 air freight controls to urgent NFO or AOG imports as to scheduled exports: identify the risk bearer, confirm coverage attachment and preserve custody evidence. For temperature-sensitive goods, carry monitoring through airport dwell and delivery, not just the flight.
On either direction, lithium batteries and other dangerous goods require the applicable ICAO/IATA compliance process. Insurance does not cure incorrect classification, undeclared dangerous goods or deficient packaging. Any special handling commitment should be confirmed operationally and reflected in the insurance submission where material.
Test coverage against the cargo’s actual failure modes
“All risks” describes a broad form of physical-loss coverage, not an absence of exclusions. Procurement should obtain written answers for the exposures that could make a claim commercially significant.
For precision machinery, ask about insufficient-packing exclusions, shock or vibration damage and internal damage without obvious external impact. Preserve manufacturer packing specifications and evidence that the equipment met them before pickup.
For biological reagents or temperature-sensitive electronics, establish whether physical damage from temperature deviation is covered. Review refrigeration breakdown, power interruption, tarmac dwell, monitoring requirements and permitted temperature ranges. A logger documents conditions; it does not establish coverage by itself.
An Incoterms 2020 air freight insurance specification should also address theft sublimits, deductibles, geographic restrictions, sanctions provisions and any security warranties. For high-value cargo, disclose the full routing and handling arrangements rather than relying on a generic commodity description.
Standard cargo policies commonly exclude delay and consequential losses. A replacement control module may be insured against physical damage without covering the production revenue lost while a plant waits for it. Treat business interruption and other specialized exposures as separate insurance questions.
The distinction between insured value, policy limits and exclusions is explored further in Shipit’s cargo insurance guide.
Recheck insurance when the transport plan changes
A line-down emergency may move one replacement part by air while the remaining order continues by ocean. A project package may combine air-freighted controls with heavy-haul delivery of the main equipment. Keep the contractual and insurance treatment explicit for each consignment.
Movement or service | Insurance review triggered by the operating plan |
Air freight, including US imports and exports | Confirm declared routing, consolidation or charter arrangements, airport handling and onward delivery |
Ocean FCL and LCL | Confirm the rule suits the transaction, container or CFS handoffs and any reefer temperature conditions |
Port drayage | Verify coverage through terminal collection, chassis moves and inland delivery; do not treat carrier liability as cargo insurance |
Cross-dock transloading and buffer warehousing | Confirm unloading, reloading and storage are covered, including duration and any separate stock coverage required |
Project cargo and heavy haul | Disclose dimensions, values, lifting operations and route constraints; verify survey or rigging conditions where required |
An Incoterms 2020 air freight arrangement does not automatically authorize insurance changes when cargo switches mode. Notify the insurer or broker before a material routing, conveyance or storage change and obtain confirmation where required by the policy.
For standard 20-, 40- or 45-foot dry containers, reefer FCL and LCL consolidations, the relevant handoffs differ from airport delivery. FOB and CIF remain unsuitable for the air portion of a split order. Identify the rule, named place and insurance responsibility for each shipment in the commercial documents.
Only add cross-docking or buffer storage where the operating plan needs it. An unplanned storage period can affect coverage, while demurrage, detention and ordinary freight charges are not automatically insured physical losses.
Build a claims file before a claim exists
The insurance certificate should connect to the sales contract, commercial invoice, packing list and transport documents. Retain delivery receipts, serial-number records, photographs, screening or repacking records and temperature or shock data where relevant.
Assign responsibility for notifying the insurer, notifying carriers, arranging inspection and preserving damaged goods. The party holding the air waybill may not be the party entitled to insurance proceeds. CIP documentation should allow the entitled claimant to pursue recovery without avoidable administrative delays.
A disciplined Incoterms 2020 air freight claims process also tracks separate deadlines. For Montreal Convention carriage, written cargo-damage complaints are generally due within 14 days after receipt; delay complaints are generally due within 21 days after cargo is placed at the consignee’s disposal. Policy notification conditions can require earlier action.
Record visible exceptions on receipt, preserve packaging and follow insurer instructions before repair or disposal. Do not wait for a carrier’s liability decision before notifying the cargo insurer.
Frequently asked questions
Can FOB or CIF be used for air freight? They are not appropriate Incoterms rules for air transport. Both are restricted to sea and inland waterway transport. FCA, CPT or CIP may fit an air transaction, depending on who arranges carriage and insurance and where delivery occurs.
Does CIP keep the seller responsible for cargo until arrival? No. Risk transfers when the seller delivers to the carrier at the agreed point. The seller still pays carriage and procures the required insurance through the named destination.
Does FCA require the buyer to buy cargo insurance? No. FCA imposes no insurance-purchase obligation on either party. However, the buyer bears risk after the FCA delivery event and should arrange appropriate protection before that event occurs.
Does CIP insurance cover missed production or commissioning deadlines? Not automatically. Standard cargo coverage generally addresses insured physical loss or damage, not delay or consequential losses. Review specialized coverage separately with the insurer.
